Privacy Policy for SportContract Services

User Data of SportContract GmbH,Baarerstrasse 99, 6300 Zug, Switzerland, (hereinafter ""SportContract"") for the SportContract Services http://www.sportcontract.net (hereinafter ""SC Services""), version of 12th April, 2017. SportContract collects personal data of visitors to and users of SC Services, which it then processes, uses and transmits. SportContract is the controller of the database. The protection of the personal data of visitors to and users of SC Services is an important matter for SportContract, who is committed to handle personal data responsibly and in accordance with the applicable data protection regulations.

In this Privacy Policy, SportContract explains to visitors and registered users of SC Services which data SportContract collects in conjunction with the use of SC Services, the purpose of this collection and the manner in which SportContract collects, processes, uses and transmits these data. SportContract states the rights to which visitors and registered users are entitled. Furthermore, SportContract hereby obtains the necessary consents from the users to process the data of the parties involved. Visitors and registered users may download or print this Privacy Policy at any time. SportContract provides certain functionalities of SC Services to registered users free of charge. These free services involve significant effort on the part of SportContract, including a financial expense, meaning that SportContract is also obliged to obtain income from advertising. This may also include personalized advertising for services and goods from other providers which are related to the content on SC Services. Successful registration therefore depends on future users of SC Services accepting this Privacy Policy, which includes the consent to the use of personal data, as identified below, for market research and personalized advertising within the scope set forth in section 3 below. In this regard, SportContract is keen on putting forward the informational content of SC Services in view of its positioning as leading information and communication platform for the global hockey and the transfer market of professional hockey players.

1 Collection of visitor / user data

1.1 SportContract’ servers automatically store every access and/or view of an Internet page or file belonging to SC Services as a log file. The following data are stored until their automatic deletion: - IP address of the accessing computer - Name and URL of the accessed file - Time of access - Transferred data volume - Mention of whether the access was successful - Identifying data of the browser and operating system of the accessing computer - URL of the referring website if the access took place via a link and, in addition, the search term used if the search took place via search engine - Name of the user's Internet service provider These data are not linked to other data and are not passed onwards. Instead, these data are only used to allow users to access SC Services (establishing a connection) and for internal system and statistical purposes, for system security or for the anonymous assessment of general user behaviour so that SC Services can continue to be developed in a user-friendly manner. They are also collected to: - Make sure, for the protection of all users, that there is no bulk download of data from the database - Continuously improve the system - Guarantee authentication or detect breaches in authentication - Ensure privacy and the exclusivity of the platform

1.2 During a visit to SC Services, SportContract will install an electronic cookie on the user's computer so that the user can be recognized if the user returns to SC Services. The cookie allows SportContract to assess each user's behaviour in order to give the user advice as to what interested the user during an earlier visit or to place advertising for an individual user profile. SportContract associates the data of this usage profile with the user's personal data in his user account. These usage and personal data are used by SportContract for market research and advertising purposes including personalized advertising for the relevant user, as described in section 3 below.

1.3 At registration, the actual first and last names, full date of birth, in the case of a player or club officials the club with which they are currently affiliated, and an e-mail address and mobile number, in the case of a player their personal e-mail address, must be provided. SportContract is entitled to verify the information through inquiries to the user. These personal data and the IP address are collected, processed and used by SportContract and, if necessary, transmitted to the extent required for the operation of SC Services so that the user can access SC Services within a closed user group as a registered user and benefit of the services offered by SC Services, including helpdesk assistance.

2 The personal and usage data of visitors and registered users will be stored, used and transmitted if necessary by SportContract on SC Services for the purposes to operate SC Services and to provide its services on SC Services as offered there from time to time, for the duration of the registration and a subsequent period of 6 months. If SportContract appoints an external service provider for this purpose, SportContract ensures that this external service provider is also bound by adequate data protection obligations and the provisions of this Privacy Policy.

3 SportContract will make SC Services as interesting an Internet platform as possible for the users by also working with partners. Partners may, for example, complement the functions of SC Services through other services, which may be free of charge or part of the premium membership. This may involve the relevant partner receiving the opportunity to advertise, either through banners, e-mail ads or even personalized advertising. No personal data will be transferred to the partner for advertising purposes; rather, the advertising will take place exclusively via the web servers of SportContract and/or its external service providers. More generally, the user's personal data, including a user profile, will never be provided to third parties by SportContract for market research or advertising purposes.

4 The SC Services website may use web analytics services (such as, for example, Google Analytics, Mixpanel, HotJar, Segment; the “Web Analytics Services”) provided by external service providers (the “Web Analytics Service Providers”). Web Analytics Services generally use cookies, which are text files placed on the user’s computer, to help the website analyse how users use the site. The information generated by the cookie about the use of the website by the user (including the IP address of the user) will be transmitted to the Web Analytics Service Providers and stored by them on their own servers, which may be located in countries that have a less strenuous data protection regulation in place than in Switzerland (for example the United States of America). The Web Analytics Service Providers will use this information for the purpose of evaluating the use of the website by the user, compiling reports on website activity for SportContract and providing other services relating to website activity and internet usage. The Web Analytics Service Providers may also transfer this information to third parties (located in any country worldwide) where required to do so by law, or where such third parties process the information on the Web Analytics Service Providers’ behalf. The Web Analytics Service Providers will not associate the IP address of the user with any other data held by them, unless the user has given his explicit consent thereto. The user acknowledges that IP masking is enabled on the SC Services website, meaning that the last octet of the visitor's IP address is removed prior to its use and storage. The user may refuse the use of cookies by selecting the appropriate settings on his browser, which may however prevent the user from using the full functionality of SC Services. Furthermore, for certain Web Analytics Services, the user can prevent the collection and use of data (cookies and IP address) by using the opt-out mechanism made available by the relevant Web Analytics Service Providers. However, this opt-out is often achieved by placing a permanent cookie on the user’s computer. This means that refusing the use of cookies might prevent the user from opting out by means of the proposed method. Furthermore, the opt-out is linked to the specific computer and browser. If the user uses another computer or browser, or if the user erases or otherwise alters his browser's cookie file (including upgrading certain browsers), the opt-out cookie may be deleted, so that a new opt-out is necessary. Furthermore, opt-out cookies generally have a limited period of validity (for example 60 months), after which the opt-out must be renewed. By using SC Services, the user consents to the processing of data about the user by Web Analytics Service Providers in the manner and for the purposes set out above.

5 SC Services may offer communication functionalities, for example live voice and video chat capabilities and other communications features, which are operated by third party service providers. The content of the communication between users via these functionalities will be processed (for example transmission or recording of video chats) by the relevant third party providers, which may be located in countries without adequate data protection legislation, including the United States. The processing of data by third party providers may furthermore be subject to their privacy policies which may deviate from this Privacy Policy. SportContract will provide the user with a list of such third party providers and their applicable privacy policies upon simple request made by using the contact form available on the platform. By using the communication facilities available on SC Services, the user consents to the processing of data by the relevant third party providers in the manner and for the purposes set out above.

6 The user gives his consent to the processing of personal and usage data in accordance with this Privacy Policy by checking the ""Privacy Policy for SC Services"" box during registration when establishing his user account. By clicking the underlying"" Privacy Policy for SC Services User Data"" link, the user may first access this Privacy Policy and read it, print it out or download it to his computer. If the user is not of adult age under applicable national laws, he must so indicate in the registration process and have his legal guardian confirm his approval of this Privacy Policy. SportContract assumes that the user has discussed this Privacy Policy and its acceptance with the persons responsible for his care." "7 Users may prohibit the use of their personal and usage data for market research and advertising purposes as set forth in this Privacy Policy at any time and/or revoke an earlier consent at any time free of charge by using the contact form available on the platform. In this case, SportContract will immediately cease any use of personal or usage data. In the case of completed registration, the relevant user's registration will expire immediately along with the cessation of data usage. In this case, SportContract may terminate a premium membership with immediate effect.

8 Users may request information at any time from SportContract regarding the use of personal data collected during use of SC Services. Thisp@ request for information may be submitted by using the contact form available on the platform.

9 SportContract may not rule out the possibility that personal data stored with it may be incomplete, incorrect or unclear even though SportContract will endeavour to verify their correctness. In this case, the user may demand the correction, blocking or deletion of such data. If, in individual cases, the deletion of data is not permitted for legal or contractual reasons, e.g. for reasons under commercial or tax law in connection with documentation obligations, SportContract will block these data. Demands for the correction, blocking or deletion of personal and usage data may be submitted by using the contact form available on the platform.

10 All personal data collected by SportContract will be handled confidentially and protected against loss, modification and unauthorized access by third parties using technical and organisational measures. The transmission of data between the user's computer and SportContract’ web servers is encrypted.

11 The protection of personal data is subject to changes in law, but also to new functional and/or technical possibilities and requirements. SportContract therefore reserves the right to modify this Privacy Policy. In such a case, SportContract will communicate the text of the new version of the Privacy Policy, together with a summary of the most important changes, to registered users via e-mail to the e-mail address registered in the user profile or by other appropriate means, for example pop-up windows, subject to a notice period of at least thirty days. This notification will require the user to express his acceptance of SportContract’ new Privacy Policy, for example by checking a tick box or clicking a link. In case the user refuses to accept the new Privacy Policy, SportContract shall be entitled to delete the user's registration and to terminate a premium membership with immediate effect, in accordance with the Terms of Service.

13 This Privacy Policy is subject to Swiss law, to the exclusion of the rules on International Private Law. Subject to mandatory law, the exclusive place of jurisdiction is at the headquarters of SportContract in Zug, Switzerland.
